Audi and VW Settle Class-Action Lawsuit over Turbocharger Repairs

If you’ve owned or leased an Audi or VW model with one of the first three generations of the ubiquitous EA888 engine and had to pay to fix the turbocharger, you may be owed money after a class-action lawsuit was settled. The case, Kimball v. Volkswagen Group of America, is now awaiting final approval from a New Jersey U.S. District Court, but once that is complete, members of the settlement class will be eligible for reimbursements.
The class-action lawsuit claimed that the turbochargers on certain Audi and VW models were defective and possibly prone to premature failure. While the VW Group continues to deny these claims, it agreed to the settlement, and the company will reimburse class members who had to pay out of pocket to repair the allegedly defective turbochargers.
Those who want to file a claim will be required to provide proof of the work, such as an invoice or written estimate. Those repairs must have also been performed within the first 85,000 miles or 8.5 years of the affected car’s in-service date. If the repair documents state that it was due to a malfunctioning wastegate, there will be a 50 percent reimbursement, but without specifying the reason, it will be capped at 40 percent. Those who had the work done at an unauthorized dealer will be eligible for up to $3580. All claims must be submitted online or by mail by November 29, 2025.
